Insulation in new home

Our home was built in late 2005 - we are having some heating issues on the 2nd floor. The home is suppose to have r-38 insulation in the attic. We are measuring 9 inches of blown in cellulose insulation - which reading on other websites equals out to be R-27 correct? Does blown in insulation settle that much in 4 months? They were also suppose to insulate the garage and there is only 3 inches in there. We live in Iowa. I know if I ask the contractor about it he will say it has settled should I accept that answer?

Is speced in the Settled state.

And when you have new insulation blow you are suppose to get a count of the number of bags used, because measuring fresh blow depth is meaningless.

I think that is an FTC rule.
