class action lawsuit? |

Hopefully all of you were able to access my previous email in which I discussed advice from my brother who is a lawyer as well as the latest visit by Correct Deck and treatment of our deck. Not sure if I posted it in the correct thread. I looked up the Trex settlement online--as some of you probably know, there was a successful class-action lawsuit in 2004 against Trex. In reviewing it, I noticed that there were only 4 paintiffs, so apparently a very large group is not necessary. I have put in a call to the lawyer who handled that case thinking that he may be interested in this one as well, since they are so similar.

Trex Class Action Lawsuit |

Just received a
FedEx letter today from Trex in response to a recent warranty claim I filed, offering to replace 66 boards on my deck, which failed (basically dissolved into composite sawdust) 18 months after installation. They also offered a staggering $206.63 as a "goodwill payment to help offset some of your additional expenses".......a nice thought, but the cost of removing old and installing new product would be around $2300.00.
Just curious if anyone out there might be in a similar predicament, as I'm looking to recover as much of the cost as possible. Does a current class action lawsuit exist? How do I join? Please advise.

I guess I gave up over a year ago, I haven't heard from anyone so I suppose others have given up also. The companies just won't stand behind their products. The only thing I have left to do is speak verrrry ill of Home Depot and Correct Deck to anyone who will listen. Sorry I am no help, but this has been going on for years. Someone should warn other people before they waste their money. |

I had a Trex deck installed by a licensed contractor in 4/06. It is cracking @ all screws at the end of the boards. I filed a claim w/trex & was informed the contractor is at fault. Screws are not to be less than 1" from the ends of the boards. The contractor is out of business & out of the state. In 4/06, what mechanism was in place by trex (if any)to inform customers/contractors that putting screws @ 3/4" would cause cracking & void the warranty?
Has anyone had this problem? I can see that the cracks will continue & the boards are breaking loose.
Trex refused to even come to my home & inspect the problem. Are there any lawsuits that I can participate in???

I believe all the companies say that it is the fault of the installer. Have you gone back and looked at the file with all the complaints about correct deck? If there is a class action suit I am unaware of it. We wanted to get one going but I guess everyone just got tired of fighting. I hate to let them get away with cheating so many people but!!! |
