exterior sheathing and leaky walls

i bought a newly constructed house in georgia in july last year. over the last several months i have noticed my unfinished basement walls leaking(water runs down them when it rains). since then i have found out that my house which is cladded in vinyl siding , no vapor barrier or housewrap, plywood or osb is sheathed in some type of paperbacked foam board apprx 1/4 inch thick and something else about 1/8th inch thick resembling cardboard. i've contacted my builder who says it is to code and he caulked all of my vinyl siding. My window are also not flush to the siding. Does anyone know what the sheathing i have on my house is? is it code here in georgia? (building inspectors will not commit to an answer) are you supposed to caulk vinyl? what should i do next? builder will not help...thanks
