water in basement due to new housing development

This may be a legal question. Or it may be an engineering question. We bought a house 5 years ago with a finished basement without any water problems. Since then, a new housing development has gone in along side our house. We have had several flooding issues since then. So much so that we have had to tear out our carpeting. Our two sump pumps have not been able to keep up when the storms hit. Also, our sump pump goes off constantly, rain, shine and even throughout the winter months. This has never happened before. Is it possible that the new development has played a role in the water table and/or the runoff from their homes? We seem to be on the low end of all the homes. If this is the case, can we pursue this legally with the builder?
