My new addition off of my house is toward my back yard, which slopes minimally and accumulates a bit of water in the spring toward the back of the lot. The addition includes a new basement (8' 8" deep). My contractor, instead of pouring the full wall, only poured 8" (contrary to the plans) then made up the difference by building up the sill plate. The I did not notice what he did (nor did the archtect!) until all of the framing was completed. This situation has created a major grading problem. On one side of the house the soil is 8" above the top of the concrete (we have not completed the backfill). He admits his mistake, but the contractor has not provided an acceptable solution to the problem.

Is there a way that will enable me to grade to the appropriate height on the wall (EG a strong waterproof shield that can be attached to the upper part of the foundation and about one foot up the outside wall? Help!!

PS this is a 2000 square foot addition.
