I signed a contract on 9-28-05 to sell my house. I told the agent I want a 2 month contract, he said the standard is 6 months, but I can fire him anytime. He also gave me a rider with his hand writing saying IF he cannot sell my house within 2 months I have the right to cancel.
Its now 2 months, and he is giving me the run around. I am starting to believe that he was being deceitful, he had me sign for 6 month listing.
I want to cancel my contract(he promised that there would be no problem)
How should I cancel. what should I do. I want to sell the home myself.
So far he brought 3 set of people and no one made an offer.

This might vary by state, but where I am, although you work with an agent, the contract is with the broker.
Now he migth be an agent/broker, but if it is more than a couple of agents then he is most likely just an agent and not the broker.
Go talk to the broker about this.

Billhart, thanks for responding. I am in NYC. He was the only one involve with the transaction (he wrote up the contract at my home). I never met anyone else.
I am going into the office today, I will ask for a broker. Hope he/she can help.
I just called the MLS of NY to get a cancellation form, and the woman said there is a form called Withdrawl of Realease and I'll have to get is from my agent.
