We have a contract on a house that in order to buy we have to sell our current house. We don't have a contingency in the contract. Our house hasn't sold and when the loan officer ran the numbers she told us that we can't afford the house without selling our house and put that in a letter. I sent that with a release from contract form to their agent. Will that release me from the contract without being in default of the contract? The sellers now have a lawyer involved and I'm worried. Also, if this goes to court, can I sue my agent for misrepresentation?
