Where I live in El Dorado County, CA the nests are actually protected by law. Fish and Game will issue citations and assess fines for destroying nests under construction. You can however deter the nesting by hanging fine netting like they use in vinyards. The following article appeared in the Mountain Democrat (our local paper). I really think you have to have a perspective to understand California politics where one government agency fines another. Enjoy.
