Hurd - Another disatisfied customer

We completely remodeled our house in 1994...to the tune of $14,000 dollars of Hurd "Insol 8" windows. Many are now fogged up badly. Come to find out....Hurd was sued for faulty windows made around that time frame...and actually settled with the owners of such. However, we were never notified by the building supply company, builder, or Hurd that such a defect or settlement exsisted. Warranty for that year appears to be 10 years pro-rated. I have a feeling I will be SOL, as one e-mail to Hurd has gone unanswered already. I'll be trying again. Anybody think I have a legal claim because I wasn't notified of this?
