New House Water In Basement

I am the happy owner of a brand new home or at least I was until I noticed my drain tiles was not allowing water to drain properly. I tested this theory in Septemeber when I took a hose and let it run down the window drain tile for about 15 minutes. I didn't get one ounce of water in my sump pump. Since I have been in my house less then 2 months I call the builder and they came out and looked at it and said everything was ok. I am getting my first down pour right now and after a visit to the basement I found a crack in the wall from floor to ceiling and water coming in spreading across the floor about 60 square feet. Is there anything I can do to get this fixed?
