re-inspect Posted by tomh on November 20th, 2003 10:06 AM In reply to Seriously sloping floor by Jim on November 20th, 2003 08:50 AM [Go to top of thread]
I think you need to get a second (written) opinion on the foundation and structure on the affected corner. If the previous home inspector, or pest control inspector, missed a significant structural defect or ongoing infestation of wood eating insects, or if the sellers failed to disclose a known defect, you have an actionable cause to collect damages. In the case of either the home or pest inspector, that would be covered by the liability policy.
I don't usually advocate or promote litigation, but this is the protection you paid for by obtaining an inspection by a qualified experts prior to purchase. Most reports contain disclaimers for concealed or inaccessible damage, and the original inspector will make that claim. However since the defect is noticable from inside the house, you might have a shot at demonstrating it would be reasonable for the defect to be detected.
First things first. Get another inspection and request a report describing the problem and cost estimates for repair. You should probably make your real estate agent aware of your concerns. Was this post helpful? Yes: or No:
