to be honest, he did disclose the issue. Now, the amount of water in the basement is subject to interpretation by both parties. What you think is a lot, may not be a lot to the previous owner. I have known people to sue over this and win, but....it was very costly for the person initiating the lawsuit. Spend that money on a contractor to get that sump crock installed and the drain tile put in. Beware of the water proofing companies to do this job, they often over charge the consumer. Try other smaller contractors first. I went with a smaller company and it was about a third cheaper and they did a great job. P.S., if you do plan on suing the previous owner, plan on dragging it out for a few years because I am assuming we are not talking a few dollars worth of work here, I am sure this basement issue will run you more than you are able to sue for in small claims court? Then an attorney will take his 1/3 off of your settlement, and then where are you? Back where you started.
