dp, you are simply misinformed on asbestos law and liability. EPA regulates the removal of friable asbestos from facilities. A facility is a commercial structure or residential dwelling consisting of at least 4 dwelling units. EPA has no jurisdiction in the subject non-friable asbestos siding on this single family home.

Civil law may allow nuisances to be abated however there must be some evidence of damage to be compensated. A civil action merely alleging the removal of non-friable asbestos using wet methods would be unlikely to prevail in a lawsuit unless the materials were haphazardly disposed in a manner that causes debris to be deposited on the plaintiffs property.

OSHA regulates asbestos exposures by employers to employees, and mandates engineering controls to reduce exposure levels, and personal protective equipment to be used where exposures above the threshold limit value cannot be assured.

Homeowners are exempt from any widespread federal regulations. Local regulations may require permits or stipulate waste disposal methods and locations. While respect of the hazards of unnecssary or occupational asbestos exposures is healthy, zero tolerance of asbestos exposure is probably unrealistic. Asbestos fiber is present in small quantities in ambient air from natural and demolition sources. Although a safe exposure level has not been found, risk for most asbestos related effects is related to dose. Mesotheleoma is the only chronic effect noted in non-occupationally exposed individuals, and its occurance is extremely rare.

I know you are passionate about this subject, but you should really obtain more information and stop shooting from the hip...emotionally anyway.
