Yes, I agree that we need to get this fixed. We moved into the house last June, and the house inspector alerted us to the messed-up wiring on these outlets. The powder room outlet is rarely used, so at this point the only hassle has been when the upstairs outlet trips, we have to go downstairs to reset the powder room in order to be able to reset the upstairs. But... yes, they need to be separated.
