oil tank leaking in front yard

I nephew purchased his home about 5 years ago. THe company making inspection said, No oil tanks are in your yard.

ALSO, the oil tank is leaking. DEM is looking into this. HOWEVER, my insurance will not pay for this. and I do not think that I should pay because I was misrepresented by the company doing my home inspection at time of purchase.

I have a wife and a 2 year old daughter.
and a dog.
THE dog had oil on his fur. I had oil on my shoes.
I took dog to get groomed.
I am concerned because the oil tank that is leaking is under the driveway, my new fence, and some of my sidewalk and street area.
I know that some will be taking care of by DEM.
HOWEVER, what about the sand, and gravel, the replace ment of the driveway, and the replacement of my new fence in the area of the oil leak.
I am so upset.
