Poly Butyl Piping Lawsuit Posted by Ron Carpenter on March 24th, 2004 12:50 AM
Subject Title: NOT PROPERLY NOTIFIED ON LAWSUIT
In Reply to: poly butyl piping lawsuit
We were not notified about the lawsuit against companies manufacturing poly butyl pipe in our home. There was no formal letter address to us about the latent defect by the manufacturer, concerning the poly butyl pipe. We've been under installation and service contract with the state's SCE&G utility contract through final payment of the installation of equipment June, 2002, and was never advised of any product problem or the class action. Nor, did SCANA, their service plan warranty we're still under contract to advise us of any problems. Seems some in the supply, sale, distribution, installation and warranty service business are trying to run for cover rather than informing their customers and responsible pursuit of properly resolving the problem .
We need recourse and to be grandfathered for the repair and replacement of the pipe under the class action. If it has settled, we request inclusion by name in an addendum to that action, after the fact and grandfathered in based on the lack of notification circumstances, as necessary and appropriate. In fact, numerous similar homes, adjacent to us were also not properly notified, as well as numerous others we've recently found on the internet. We need help and assistance. Thank you.
Sincerely,
Ron Carpenter
