My first question is: why would you accept such a shoddy job? Formica is not repairable in the sense making it like it was new; the only way to fix it is to replace that piece from the seam to the end. Handling the backsplash/wall juncture depends on how flat the wall is, and is, to some extent, a matter of taste, but unless the wall is hidiously crooked, a reasonable good fit should be possible. I agree with Den, of course, if he is unlicensed, it could be tougher and depends your state's laws.
