I am having a new home built and was looking at the load bearing beam installed in the basement and have noticed that on 1 side of the beam that sits on the foundation wall seems to have broken off below the beam. Maybe 4-5 inches deep in the shape of a pie slice. The builder has tried to patch this in with some form of concrete. My question is by just patching it up does the integrity of the beam become compromised. I would say that more than 75% of the beam still sits on the foundation wall.

I'm a lawyer.

Builder is required to proceed in a workman, professional manner and a cracked support beam is not per code or per your contract w him.

Ask that it be replaced now before any more work is done.
