I live in the town of Brookhaven NY & after getting all the permits - put an extention on my home for my Grandchildren. I past all the inspections, cement, framing insulation plumbing -electrical. After my survey was done - they told me my extention was 12inches to big. I had to pay $540 for a town hearing & hirer an expediter - Now after all that they told me I put in an illegal cellar entrance. This door has been on the house since it was built in the 1950. Today the inspector came & looked at it and said they had to look at the basement. Now they tell me I need a permit for a finished basement. My basement does have some drywall on the wall (which was there when I bought the house in 1982 - but it has a concrete floor and no heat. So my question is finally - what is a finished basement discription. Thank you Rita

I guess you should be asking them to state in writing what is a LEGAL definition of a finished basement. I don't think a drywall wall constitutes being finished, but maybe they are just stating that if you want to finish it for living space, a permit is needed.

Did the contractor build it 12" bigger than planned? Seems the measurement issue should have been caught before finished.

If the door was there when the house was built, it should be fine. I would assume it would be "grandfathered-in".

Just because an inspector comes to your house doesn't mean you have to let them in.

You should know your legal and constitutional rights.

Lastly, if you feel you are being wronged, hire an attorney. Most towns will back off at that point because they do want the expense of a case they will most likely lose since the addition is already built.

Thank You - I am going to take your advise & ask them in writing what they consider a finished basement & I might just get that attorney
